Terms of Service

Relationship:

All coaching services and communication, email or otherwise, delivered by Jan L. Bowen and through www.JanLBowen.com dba Strategic Solutions Services, LLC (the “Coach”) are intended as beneficial information to assist you in your life progression, not as a substitute for medical care. Jan, independently and through her company, makes no representation that the information provided is licensed health care. Coaching may augment your medical therapy, but is not meant to be a substitute for clinical counseling, treatment for suicidal ideation, clinical depression or severe psychiatric diagnoses.

As a client, it is important to understand the difference between coaching and clinical counseling or psychotherapy. While there are similarities between them, the major differences are in the goals, focus, and level of professional responsibility. Clinical counseling and psychotherapy are health care/medical services which are frequently reimbursable through health insurance policies. Coaching is not a health care or medical service. Therefore, coaching services are not reimbursable through health insurance policies.

Coaching is a professional relationship. While it may often feel like a close personal relationship, it is not one that can extend beyond professional boundaries. Considerable experience shows that when boundaries blur, the benefits gained from the coaching relationship are endangered. By purchasing coaching services from Jan, you confirm that you have read and agreed to the information contained here.

Responsibilities

  • Coach agrees to maintain the ethics and standards of behavior set by the International Coach Federation (ICF), of which she is an active member in good standing. http://www.coachfederation.org/ethics
  • Coaching is not therapy and the Coach (Jan L. Bowen) is not a licensed therapist. Coaching does not substitute for therapy when it is warranted, and does not prevent, cure, or treat mental disorders or medical diseases.
  • Client is fully responsible for their well-being, which entails creating and implementing physical, mental and emotional decisions, choices, actions, and results. The Client agrees that the Coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by the Coach.

Services

The parties agree to participate in a Coaching Program selected by the Client. Meetings will take place via Skype, Zoom, or phone, unless otherwise agreed upon. Coaching is delivered during regularly scheduled sessions.

The sessions will follow the needs and agenda of the Client. The overall pace and eventual outcome will be largely determined by the level of Client commitment and focus. Therefore, it is essential for optimal results that the Client make a commitment to the process. The Coach will assist you with homework, and guide you with follow up. Your potential is a result of your choices and decisions. All are respected. Thus, Client is aware results are not guaranteed.

Coaching sessions

Client is responsible for scheduling the sessions and the Client will call or meet Coach at prescheduled time. If the Client is more than 15 minutes late for a session, that time will be forfeited. If the Client is late but less than 15 minutes, the Coach may need to end the session at the originally scheduled time in order to accommodate her original calendar. If time permits, she may extend the time period.

Client may be responsible for coaching session fees for any regularly scheduled calls that the Client cancels with less than 24 hours email notice.

Payment(s)

Payment(s) must be received a minimum of 24 hours in advance of session. For programs requiring preparation, payment is due before planning will commence.

Confidentiality

This coaching relationship, as well as all information (documented or verbal) that the Client

shares with the Coach as part of this arrangement, is bound to confidentiality by the ICF Code of Ethics and is held in the strictest confidence. However, unlike medicine or law it is not considered legally binding. As a matter of ethics and principle, the Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: was in the Coach’s possession prior to its being furnished by the Client; is generally known to the public or in the Client’s industry; is obtained by the Coach from a third party, without breach of any obligation to the Client; and is independently developed by the Coach without use or reference to the Client’s confidential information; or that the Coach is required by law to disclose.

Release of Information

The Coach retains the right to share the Client’s name and number of coaching hours

as required for documentation for coaching certifications in the industry. The Coach engages in continuing education and pursues ICF and industry credentialing. That process may require the Client’s name, contact information, dates and/or number of coaching hours. By agreeing to these Terms and Conditions, the Client agrees to have only

the above-mentioned information shared with the credentialing organization for the sole purpose of verifying the coaching relationship. No personal notes will be shared. According to the ethics of this profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, without divulging particulars that expose Client identification.

Indemnification and Liability

Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. In no event will the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date. The Client agrees to utilize these services will the full understanding that Jan L Bowen and Strategic Solutions Services, LLC and its employees and volunteers are in no way liable for the Client’s decisions, actions and outcomes. Client also agrees to hold Jan L. Bowen, Strategic Solutions Services, LLC and its employees and volunteers free of all liability and responsibility for any adverse situations created as a direct or indirect result of a specific referral, advice given or any actions taken while working with or as a direct result with Jan L. Bowen or Strategic Solutions LLC.

Termination

Either party has the right to terminate the relationship with one week’s written notice. No refunds will be given for coaching packages.

Refund Policy

During the process of Coaching, clients may encounter resistance within themselves. This resistance is part of the process and needs to be overcome in order to fully benefit from all the many advantages of Coaching. For that reason, I have a strict Refund Policy.

  • Refunds requested in writing prior to the beginning of a Coaching program will be prorated according to amount of preparatory work completed on behalf of the Client. A mandatory $150 administrative fee will be charged.
  • After the Coaching program has begun, unused sessions will not be refunded but may be rescheduled for up to 12 months after the initial payment.
  • All unused sessions expire after 12 months.
  • Credit may be given to the Client if good faith is shown for future coaching efforts and active participation.
